LEGAL INFORMATION
NEXT LEVEL, along with its affiliates ("NEXT LEVEL," "Company," "we," "us"), provides this website and related services (collectively, the "Site") subject to the following Terms of Use. Please read this Agreement carefully. By accessing or using the Site, you agree to be bound by these terms and all incorporated references. If you do not agree, do not use the Site.
This Agreement is made between the Company and you, the Site visitor and/or registered user ("you"). This agreement, along with our Privacy Policy, contain the terms upon which we agree to provide, and which govern the use and operation of, the Site. This Agreement is a contract that will govern your access and participation in offerings on our Site.
We hope there are not any disputes between NEXT LEVEL and you, but in case there are, there are some rules, below, for how to resolve them. Please read the Limitation of Liability section below.
We may update this Agreement (including our Privacy Policy) from time to time, for example, to reflect changes to our services, business practices, legal or security requirements, or to prevent misuse. Updates may include:
- Changes to these terms and conditions;
- Modifications to the Site, including features, availability, or content;
- Adjustments to fees or the introduction of new charges.
We'll provide notice of any changes in a manner we consider reasonable. Changes won't be retroactive and will take effect after notice is given. By continuing to use the Site, you accept the updated terms. If you don't agree with the changes, you should stop using the Site. Please review this Agreement periodically to stay informed.

WARRANTY INFORMATION; DISCLAIMER
The Site and all related services, content, and features are provided "as is" and "as available," without warranties of any kind, express or implied. NEXT LEVEL and its affiliates, suppliers, and agents disclaim all warranties, including those of title, merchantability, fitness for a particular purpose, non-infringement, and data accuracy.
We do not guarantee uninterrupted or error-free use of the Site, nor do we ensure the Site is free of viruses or other harmful components. You are solely responsible for the equipment and connections needed to access the Site and assume all risks associated with its use.
NEXT LEVEL does not control or verify user-submitted content and is not responsible for inaccuracies, errors, or third-party changes to the Site. We are not involved in transactions between candidates and employers, nor do we guarantee outcomes related to resumes or job postings. You are solely responsible for the content you post.
We are not liable for any damages arising from your use of the Site, including interactions with third parties, or disputes between users. By using the Site, you release NEXT LEVEL from any claims or damages arising from such disputes or risks.
Some jurisdictions do not allow certain warranty disclaimers or damage exclusions, so these limitations may not apply to you.
LIMITATION OF LIABILITY
We do not limit or exclude liability where it would be unlawful to do so, including for fraud, intentional misconduct, or knowing violations of the law or this Agreement.
Where permitted by law, NEXT LEVEL and its affiliates, suppliers, advertisers, agents, and sponsors are not liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including loss of use, profits, business, revenue, or data) regardless of legal theory or whether we knew such damages were possible.
To the extent allowed by law, our total liability to you or any third party is limited to $100 USD.
ACKNOWLEDGEMENT
This Site may contain links to third-party websites ("Linked Sites") that are not controlled or endorsed by the Company. We are not responsible for their content, policies, or any loss or damage resulting from their use. When you visit a Linked Site, your information is subject to that site's privacy practices. The presence of our logo or content alongside a Linked Site does not imply affiliation or endorsement by either party.
VOID WHERE PROHIBITED
While the Site is accessible globally, not all products or services are available in all locations. We make no guarantees that content is appropriate or available outside the U.S. Accessing the Site from other regions is at your own risk, and you are responsible for complying with local laws. We may limit access to the Site or its services by location, user, or quantity at our sole discretion.
CODE OF CONDUCT
By using the Site, you agree not to, without written permission from NEXT LEVEL:- Post false, misleading, outdated, or incomplete job or resume information.
- Post jobs that are not hospitality-related or not affiliated with your verified organization.
- Use excessive keywords, duplicate or plagiarized job posts, or mislead applicants.
- Include unauthorized contact info or bypass the "Apply Now" function.
- Resell access, share login credentials, or allow unlicensed users access.
- Use bots, scraping tools, or unapproved software to access or store Site data.
- Leave expired or on-hold job postings live for more than 24 hours.
- Spam or solicit Site users via email, phone, or direct message.
- Impersonate others or misrepresent your affiliation.
- Respond to job postings on behalf of others or delete others' content.
- Interfere with other users' access or functionality of the Site.
- Post unlawful, infringing, harmful, or offensive content or software.
- Post job ads that violate employment laws or discriminate unlawfully.
- Contact users unsolicited for commercial or recruiting purposes outside of posted jobs.
- Reverse engineer, disassemble, or modify any part of the Site.
- Remove proprietary notices, frame or mirror the Site, or data mine its content.
- Collect or use candidate information for non-hiring purposes.
By using the Site, you agree to:
- Provide and maintain accurate, up-to-date information;
- Keep your login credentials secure;
- Be responsible for any authorized third-party use of your account;
- Notify us immediately of any security issues or unauthorized access;
- Comply with all applicable laws and regulations.
You acknowledge that NEXT LEVEL is not responsible for hiring decisions and cannot be held liable for any losses arising from your use of the Site. You agree to hold the Company harmless from any related claims or damages.
While not obligated to do so, the Company reserves the right to monitor, modify, or remove content posted to the Site and may disclose such content to third parties to protect users, comply with laws, or ensure proper operation.
We may suspend or terminate your access, without notice, for violations of this Agreement, including failure to follow the Code of Conduct or Privacy Policy.
RESTRICTED RIGHTS LEGEND
Use, duplication or disclosure by the United States government is subject to the restriction as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software Clause as DFARS 252.227-7013 and FAR 52.227-19, as applicable. When you purchase through the Site, your payment and required information are processed by a third-party payment processor. By providing this information, you agree it is accurate and authorize us to instruct the processor to complete your transaction. You are responsible for all charges and applicable taxes at the prices in effect when incurred. Each payment processor has its own terms, which we are not responsible for. You agree to review and comply with them. If there's a conflict between this Agreement and a processor's terms, this Agreement governs. We are not liable for unauthorized use of your payment method. All purchases are non-refundable unless otherwise stated or required by law.
SUBMISSIONS
By submitting or posting any materials or Content to the Site, you grant us a worldwide, royalty-free, sublicensable, and perpetual license to use, reproduce, distribute, adapt, display, and create derivative works from your Content in any media. You also permit us to display your logos, trademarks, and company name on the Site and in public materials. You retain ownership of all copyrights and trademarks. You confirm you have the authority to grant these rights. The Company does not endorse or guarantee the accuracy of any Content and may remove any Content at its discretion. Communications through the Site are not confidential.
REGISTRATION; USE OF SECURE AREAS AND PASSWORDS
Some Site areas require registration. By registering, you agree to provide accurate, current information and keep it updated. If your information is false or incomplete, we may terminate your access.
Your username will be your email, and you must choose a password. We may reject usernames that are offensive, misleading, or infringe on rights. You're responsible for keeping your password confidential and not sharing or reselling access. Multiple users on one account require written permission from us, which we may deny.
If you suspect your account is compromised, job seekers and employers should update their password and notify us at info@nextlevelkkw.com. You are solely responsible for all activity under your account.
CLAIMS OF COPYRIGHT INFRINGEMENT
If you believe content on our Site infringes your copyright under U.S. law, you or your agent may submit a removal request including:
- your signature;
- identification of the copyrighted work;
- identification and location of the infringing material;
- your contact information;
- a good faith belief statement; and
- a statement of accuracy under penalty of perjury.
If you believe a copyright claim against you is mistaken, you may submit a counter-notice. All notices must comply with DMCA requirements (see copyright.gov).

MISCELLANEOUS
You and NEXT LEVEL agree that Arizona state and federal courts have exclusive jurisdiction over any disputes related to this Agreement or the Site, waiving any objections to venue. The prevailing party is entitled to costs and attorney's fees.
Severability: If any part of this Agreement is unenforceable, the rest remains effective, and an enforceable term reflecting the original intent will replace it.
Waiver: Failure to enforce any term does not waive the right to enforce it later. Waivers must be in writing and signed by NEXT LEVEL.
Entire Agreement: This Agreement, including the Privacy Policy, is the complete agreement between you and NEXT LEVEL, superseding all prior agreements. It is non-transferable without written consent. Section headings are for convenience only. NEXT LEVEL may terminate your Site access at any time.
LEGAL NOTICES
Under California Civil Code Section 1789.3, California residents are entitled to the following specific consumer rights information:

We reserve the right to change fees, surcharges, monthly or other periodic subscription fees or to institute new fees at any time as provided in this Agreement.
